Sounds like a negligence case. Duty of care of operator to ensure that it has done reasonable measures to prevent accidents from happening.

yeah the purpose of the net in the first place is to prevent balls from flying out right? if it doesn't serve that purpose then it needs to be altered. even if there aren't any cars there someone walking by might get hit! and then end up like this guy:
